He thought that there was a glimmer of hope. After years of trying to put a life-changing experience behind him once and for all, Matthew Sims found out that it wasn’t meant to be. At least not now. Sims has been in a years-long struggle in the judicial system to clear his name and get back on with his life. Sims was arrested almost four years ago after being involved in a domestic disturbance with his then-fiancée, who claimed that he assaulted her. He says that night turned his world upside down as he has spent the remaining years trying to have his day in court, but a prosecutor, he says, is doing everything to prevent it, even though Sims has practically been his own counsel. It has been one setback after another for the beleaguered Sims, as he has appeared in court a total of 29 times. “It seems like the goalposts are being pushed further back,” said Sims after the latest setback. Sims' last hearing was on December 19, 2023, when he thought the presiding judge would set a trial date.

However, the prosecutor was able to convince the judge that he hadn’t had time to prepare for a trial, even though the District Attorney’s office, with a second prosecutor, has been on this particular case for almost four years. According to Sims, the prosecutor told the judge that his office needs medical records to support his allegations against Sims, which have been difficult to attain. The prosecutor also said that he is attempting to set up dates when doctors if called, will be able to offer their testimony. Sims is being charged with two felony counts of Domestic Abuse from the incident that began back in May 2020. Sims believes that perhaps one of the reasons his case has not gone to trial is because the arresting officer is no longer employed by the Monroe Police Department (MPD), and his whereabouts are presently unknown, according to Sims. The charges against Sims are from the records in the report by the arresting officer, who may have to be called to testify when the case goes to trial.

The fact that the December 19, 2023 hearing did not result in the setting of a trial date has made it extremely difficult for Sims to get back to some semblance of a normal life. He has lost several jobs, and when he applies for one, a background check will reveal that charges “are pending” against him, further putting his situation in a state of limbo. “My life has been destroyed,” he said, “by the false allegations made against me, and by malicious prosecution of my constitutional rights.” Sims continued, saying, “I am the victim that started when the arresting officer presumed him guilty without speaking to me prior to arresting me.”

The officer that investigated the case, because in his (officer's) judgment, the case “was resolved due to arrest.” Sims also believes that when he didn’t accept a plea deal with prosecutors, charges were suddenly upgraded to felonies three years later. Sims has another hearing slated for April 25, 2024, as he is hoping that the presiding judge will reject any calls for delays and set a trial date. He has maintained his innocence all along and believes that what he will present at a trial will absolve him of any crimes, knowing that in some of the incidents, it takes two to tango. Then he says, “I will have cleared my name and can get on with the rest of my life.”
